Virginia drivers have a legal obligation to stop at the scene of an accident. A failure to stop following involvement in an accident that has resulted in property damage, injury, or death may be a misdemeanor or felony offense, depending upon the damage the accident has caused.

  • Under Virginia law, a driver may face Class 1 Misdemeanor charges if he or she leaves the scene of an accident that results in property damage of $1,000 or less.
  • A driver may face Class 5 Felony charges for leaving the scene of an accident that results in more than $1,000 of property damage or that causes injury or death.

After an accident, a driver must stop as soon as it is reasonably safe to do so. Upon stopping, he or she must exchange information with the other party or parties involved (including driver’s license information, contact information and insurance information). The driver must also take action to render aid to those in need of medical assistance.
